Cynyma respects the intellectual property rights of others and expects its users to do the same. This policy outlines the procedures for reporting copyright infringement and the accelerated timelines required under 2026 digital regulations.
1. REPORTING INFRINGEMENT (TAKEDOWN NOTICE)
If you believe that your copyrighted work has been copied in a way that constitutes infringement and is hosted on Cynyma.com (on our AWS servers or via user uploads), please use our DMCA Takedown Form or send a written notification to our Copyright Agent at the email mentioned below.
Your notice must include:
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing (including the specific URL on Cynyma.com).
- Your contact information, including address, telephone number, and email.
- A statement of "Good Faith": That you have a good faith belief that use of the material is not authorized by the copyright owner.
- A statement of Accuracy: That the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.
- A physical or electronic signature of the copyright owner or authorized agent.
2. COMPLIANCE TIMELINES (2026 STANDARD)
Cynyma operates under a tiered response architecture to remain compliant with global and local laws:
- Government/Court Orders: In accordance with the IT Rules Amendment 2026, content deemed illegal by a court or government authority will be removed within 3 hours of receipt of a valid order.
- Standard Copyright Notices: For valid DMCA/Copyright notices from private individuals or studios, we aim to disable access "expeditiously," typically within 36 hours.
- Sensitive Content: Non-consensual deepfakes or intimate imagery will be prioritized for removal within 2 hours.
3. THIRD-PARTY API CONTENT (TMDB)
Cynyma displays movie metadata and posters via the TMDb API.
- Direct Hosting: If Cynyma has cached or hosted a specific image on our AWS servers that is found to be infringing, we will remove it upon valid notice.
- External Links: If the infringing material is hosted on TMDb’s servers and merely linked via API, we cannot delete the file from their servers. However, we will immediately disable the link/display of that resource on Cynyma.com to ensure the content is no longer accessible via our platform.
4. COUNTER-NOTIFICATION PROCESS
If you believe your content was removed by mistake (e.g., you have the rights or the use is "Fair Use"), you may file a counter-notice by emailing to the email address mentioned below.
Your counter-notice must include:
- Identification of the material that was removed and its original location.
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the courts in Kochi, Kerala (for Indian users) or the federal district court for the judicial district in which your address is located (for US users).
5. REPEAT OFFENDER POLICY
Cynyma maintains a strict "Three Strikes" policy to deter persistent infringement:
- The Rule: Any user who receives three (3) valid copyright strikes within a six (6) month period will have their account permanently terminated.
- Automated Prevention: We utilize automated digital fingerprinting to prevent the re-upload of content that has previously been removed due to a valid takedown request.
- Evidence Retention: In compliance with the IT Rules 2026, we retain records of removed content and user metadata for at least 180 days for potential legal investigation, even if the account is terminated.
6. USER DECLARATIONS (SGI/AI CONTENT)
As part of our commitment to authentic cinema culture and 2026 compliance:
- Users must affirmatively declare if uploaded media is Synthetically Generated Information (SGI).
- Cynyma uses technical measures to verify these declarations. Failure to disclose AI-generated content that infringes on a celebrity's likeness or copyright may result in immediate account suspension.
